La Cour de justice etait confrontee a nouveau a la question de la discrimination a raison de l'orientation sexuelle, cette fois-ci a propos de l'exclusion permanente au don de sang prevue par la reglementation francaise pour les hommes ayant eu des rapports sexuels avec des hommes. Se tournant vers le juge, les justiciables ne sont pas toujours en mesure d'y recevoir une reponse satisfaisante, tant les dilemmes societaux et ethiques devraient avant tout relever de la responsabilite premiere des legislateurs nationaux.//The European Court of Justice was again confronted with the question of the discrimination on grounds of sexual orientation, about the permanent exclusion of blood donor provided by French regulation for Men who have Sex with Men (MSM).
