Résumé
Pour la premiere fois, la Cour europeenne des droits de l'homme etait confrontee, dans l'affaire Dieudonne M'Bala M'Bala c. France, a la question de savoir si l'article 17 de la Convention peut s'appliquer a des propos abusifs tenus lors d'un spectacle et relevant donc a priori de la liberte de creation artistique. La reponse apportee confirme la fermete du juge europeen face aux theses revisionnistes et antisemites et semble conforter l'approche suivie par le Conseil d'Etat francais dans ses ordonnances de janvier 2014 a propos de l'interdiction d'un precedent spectacle du requerant.//For the first time, in the case Dieudonne MBala MBala c. France, the European Court of Human Rights had to investigate whether article 17 of the Convention could apply to abusive comments which were expressed during a show and might consequently fall under the field of artistic creation.
