Abstract
The author is interested in the issue of the legality of the Covid-certificate and even more in the ethical problems it raises. Indeed, with the Covid-19 epidemic, fundamental freedoms have been widely abused, even "deactivated", revealing a real democratic crisis in parallel with the health and economic crisis. This article highlights the risk of a split in society that the adoption of the Covid-certificate would cause, since such a device would be tantamount to making a distinction between citizens who are ready to accept measures restricting their freedom and those who are not. After summarizing the decisions of the Council of State and the Constitutional Council in which the Covid-certificate was declared acceptable and accepted, the author raises the questions that the European Court of Human Rights could ask itself when judging the validity of this device.
