(French law of social and medico-social institutions) - The nursing home that welcomes elderly people with Alzheimer's disease is not allowed, for safety reasons, to prevent them from entering and exiting freely. The unexpected leakage and accidental death of a resident induces the commission of a fault of culpable oversight. In terms of liability, not only compensation to heirs is based on a tort, under relational loss, but also on a contractual basis, as part of the legacy of the claim of responsibility held by the deceased according to the contract.
